Illegal telemarketing: Italian data protection supervisory authority imposes 8,500,000 euro fine

The Italian data protection supervisory authority (“Garante per la protezione dei dati personali”) has imposed a fine on the Italian electricity and gas company Eni gas e luce SpA in the amount of €8,500,000. euros for unlawful telemarketing.

The subsidiary of the energy group ENI made telephone calls as part of an advertising campaign. In doing so, the company acted without the consent of the persons called. The processing of corresponding objections remained unsuccessful due to inadequate technical and organizational measures. In addition, the company violated regulations on the retention and deletion of personal data. This is not the first time that the company has violated data protection. A fine of over 3 million euros has already been imposed on the company in this connection. In total, about 7200 people were affected by the improper campaigns.
