The updated <a href=\"https:\/\/edpb.europa.eu\/sites\/default\/files\/files\/file1\/edpb_guidelines_202005_consent_en.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">EDPB Guidelines<\/a> stem from the Article 29 Working Party&#8217;s guidance on consent under the GDPR, which was already endorsed by the EDPB on April 18, 2018.<\/p>\n<\/div><div class=\"container con--heading\">\n<h3 class=\"wp-block-heading\">Key messages:<\/h3>\n<\/div><div class=\"container con--list\">\n<ul class=\"wp-block-list\"><li>With regard to <strong>cookie walls<\/strong>, the EDPB notes that website operators could not make access to content on their website conditional on a visitor agreeing to allow their data to be processed, as consent obtained in this way cannot be considered to be freely given.<\/li><li>With respect to alternative implementations such as <strong>&#8220;swiping&#8221; or &#8220;scrolling<\/strong>,&#8221; the EDPB Guidelines further indicate that scrolling or swiping through a webpage or similar user activity does not constitute an affirmative action that meets the requirements for effective consent under the GDPR.
